Trial Terms of Use

Trial access of the SPIE Digital Library is made available to your institution for a limited trial period, at no charge, solely for the purpose of evaluation. It is understood that you and your institution accepts and agrees to the TERMS OF USE detailed below the first time you access the SPIE Digital Library and until the trial period is concluded.

AUTHORIZED USERS

  • • SPIE grants to Authorized Users at Client’s facility online access to the SPIE Digital Library for the trial period. “Authorized Users” means the employees, faculty, staff, and students officially affiliated with the Client and persons with legal access to the Client’s library collections and facilities on-site, using an IP address within the ranges supplied by the Client.

  • • The Client agrees that common and reasonable methods will be used to inform Authorized Users of general terms and conditions for the use of the SPIE Digital Library during the Trial period and will make every reasonable attempt to enforce the Terms of Use.

USER May

  • • download, save, or print text, search results, or other information from the SPIE Digital Library solely for their private use.

  • • copy and transmit content from individual papers or articles in “person-to-person” and non-systematic scholarly exchanges of information between Authorized Users.

USER May NOT

  • • alter, recompile, resell, publish or republish any proceedings or journal text, output search result, or other information from the SPIE Digital Library in any form or medium.

  • • systematically or programmatically download, print, transmit, or copy content included in the DL. Redistribution of SPIE Digital Library content is prohibited.

  • • transmit an electronic paper in digital form to any person not officially associated with the Client.

  • • use material for Interlibrary Loan (ILL) and Document Delivery.

TERMINATION

This Agreement may be terminated immediately by SPIE if any term or condition of this Agreement is violated for any reason.


COPYRIGHT

The Digital Library contents, including abstracts, are copyrighted by SPIE, and are subject to all applicable copyright, database protection and other rights of the copyright owner under the laws of the United States and other countries. Copyright notices may not be removed, obscured, or modified.


DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

SPIE MAKES NO WARRANTY OR REPRESENTATION OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO THE SPIE DIGITAL LIBRARY, INCLUDING THE QUALITY, ORIGINALITY, SUITABILITY, SEARCHABILITY, OPERATION, PERFORMANCE, AND COMPLIANCE WITH ANY COMPUTATIONAL PROCESS, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SPIE SHALL NOT BE LIABLE FOR: EXEMPLARY, SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR OTHER DAMAGES, ARISING OUT OF OR IN CONNECTION WITH THE TRIAL, THE USE OR INABILITY TO USE THE SPIE DIGITAL LIBRARY, SPIE’S PERFORMANCE UNDER THIS AGREEMENT, TERMINATION OF THIS AGREEMENT BY SPIE OR THE LOSS OF DATA, BUSINESS OR GOODWILL, EVEN IF SPIE IS ADVISED OR AWARE OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL SPIE HAVE ANY LIABILITY FOR ANY CLAIMS, LOSSES OR DAMAGES ARISING OUT OF ANY BREACH OR TERMINATION OF THIS AGREEMENT, INCLUDING WITHOUT LIMITATION DUE TO NEGLIGENCE.

The foregoing limitation of liability shall apply regardless of the success or effectiveness of other remedies.

The Client assumes sole responsibility for all use of the SPIE Digital Library by each Authorized User.
